Pesalah berhak kepada Laporan Maklumat Pertama (FIR) sepertimana SEKSYEN 51A KANUN TATACARA JENAYAH:-
Di dalam kes ANTHONY GOMEZ V KETUA POLIS DAERAH KELANTAN  2 MLJ kes Mahkamah Persekutuan di mana Suffian LP memutuskan seperti berikut:-
“public document within the meaning of s74 of the Evidence Act 1950. Although s76 of the Evidence Act 1950 is silent as to the right of the applicant to inspect the FIR, his Lordship opined that the accused had a right to inspect the FIR and to be supplied with a copy of it under the common law because of his interest in it.”
Merujuk HUSDI V PP  2 MLJ 304 dimana Syed Othman FJ mengulas mengenai hak tertuduh untuk dibekalkan dengan salinan FIR dengan contoh berikut:
“If a woman lodges a complaint alleging rape, by supplying the accused with the FIR, he is given an opportunity to explain the circumstances; he may show that the woman consented.
Similarly, if he is accused of murder in a FIR, he may explain that he was elsewhere at that time, or that the act was an accident.
Since in the accident cases, copies of FIR are supplied on payment of a prescribed fee, then there should be no distinction with supply of copies of the FIR in criminal cases.”
