0 [1430.23] PENYELEWENGAN PELUANG PERNIAGAAN

Peluang perniagaan adalah apabila sesebuah syarikat mempertimbangkan atau yang mana syarikat itu berminat. Penyelewengan, eksploitasi atau pengalihan peluang perniagaan oleh pengarah yang memihak kepada dirinya sendiri atau orang yang berkaitan dengannya atau kepada entiti di mana pengarah mempunyai kepentingan. Ini boleh dilihat SEKSYEN 218(1)(d) AKTA SYARIKAT 2016 sepertimana berikut:-

(1) A director or officer of a company shall not, without the consent or

ratification of a general meeting—

(d) use any opportunity of the company which he became aware of, in the performance of his functions as the director or officer of the company;

To gain directly or indirectly, a benefit for himself or any other person, or cause detriment to the company.
