[1403.23] KEPERLUAN MEMBANGKITKAN ISU PEMBELAAN SEWAKTU TAHAP KES PENDAKWAAN


Walaupun OKT mempunyai hak untuk berdiam diri sewaktu tahap kes pendakwaan, namun, kegagalan OKT untuk membangkitkan pembelaannya sewaktu tahap kes pendakwaan dan hanya menunggu sehingga tahap pembelaan untuk membangkitkan pembelaan tersebut, melayakkan Mahkamah untuk menyifatkan pembelaan tersebut sebagai satu bentuk pemikiran terkemudian (‘an afterthought’). Mahkamah Rayuan di dalam kes terbaru, Kagatree Pechi v. PP & Another Appeal [2023] MLRAU 37 (mengikuti penghakiman di dalam dua kes Mahkamah Persekutuan iaitu kes Teng Howe Seng v. PP [2009] 1 MLRA 369 dan kes Alcontara a/l Ambross Anthony v. PP [1996] 1 MLRA 47) menyifatkan bahawa watak ‘Raja’ yang disebutkan hanya sewaktu tahap pembelaan, yang mana watak ini tidak pernah langsung dibangkitkan sewaktu tahap kes pendakwaan, boleh dikatakan sebagai satu bentuk fikiran terkemudian:
“[37] Next, regarding the appellants' defence, the trial judge comprehensively analysed the defence as reflected in the grounds of judgment. As regards the 1st appellant's defence, essentially, the 1st appellant denied committing the offence and shifted the blame to a person known as Raja. The character of Raja was never raised during the investigation or at the prosecution stage. It was only raised at the defence stage. In the circumstances, the trial judge is entitled to make a finding that the defence is an afterthought.”
