Seseorang Majistret boleh ditukarkan menjadi Pendakwa Raya dan sebaliknya. Di dalam keadaan ini, Majistret tersebut seeloknya mendengar sehingga habis kes-kes yang telah didengarnya. Prinsip ini boleh dilihat di dalam kes PP v Kulasingam [1974] 2 MLJ 26 yang mana Mahkamah memutuskan seperti berikut:-
-Held: "it would be proper for the Magistrate who is appointed Federal Counsel or DPP to complete any part heard cases originally by him in court where he was previously stationed subject to the following that there must not be any possible miscarriage of justice or any contravention of the rules of natural justice.
