[1029.21] BOLEHKAH MAHKAMAH MAJISTRET PERINTAH LEPAS TANPA DIBEBASKAN (DNAA) KES KOD 81?


Setiap kes mempunyai nombor kes yang berbeza-beza. Namun, apa yang perlu kita ketahui adalah nombor-nombor tersebut merupakan kod bagi setiap kategori kesalahan yang dilakukan.
Untuk kes jenayah, kod kes 81 merupakan kod bagi kes-kes komital ke mahkamah tinggi. Dengan kata mudahnya, kes-kes dibawah kod 81 ini adalah kes-kes Mahkamah Tinggi yang pada awalnya dipertuduhkan di Mahkamah Majistret, dan kemudian dipindahkan ke Mahkamah Tinggi.
Namun, adakah Mahkamah Majistret mempunyai bidang kuasa untuk DNAA OKT pada peringkat ini?
Dalam kes PP v. Shaifudin Khairudin & Ors [2006] 5 CLJ 678, Mahkamah memutuskan seperti yang berikut:-
“The Magistrate has no inherent power in a criminal case to grant a DNAA where the consent of the public prosecutor to transmit the case to the High Court under Section 177A of the Criminal Procedure Code has been delayed or not tendered as yet. Although the Order of the Magistrate to grant the DNAA was to prevent injustice, delay and the process of the Court from being abused, the Magistrate still had no power to order a DNAA as she had no jurisdiction to try the charge of murder under Section 302 of the Penal Code as it was triable exclusively by the High Court”.
Namun, bidang kuasa Mahkamah Majistret untuk menjatuhkan DNAA ini hanya terhad kepada kes-kes yang man kod kes ialah kod 81. Selain daripada kes-kes komital ke Mahkamah Tinggi ini, Mahkamah Majistret masih mempunyai bidang kuasa untuk DNAA seperti di dalam kes Maya Ahmad Fuaad Lwn PP [2021] 1 CLJ 291 dimana dalam kes tersebut, Mahkamah Majistret menjatuhkan hukuman perayu dilepaskan tanpa dibebaskan (DNAA) kerana Majistret tersalah arah dari segi fakta dan undang-undang. Selain itu, prinsip utama dalam kes PP v Saimin & Ors [1971] 1 LNS 115 juga menyebut:-
“If the learned Magistrate was not satisfies with the case of the prosecution, it was his duty to acquit and discharge the accused at the close of the prosecution case.”
